Landscape Installation Work Terms and Conditions

  • Scope of Work: The Contractor will carry out and complete the landscape works described in the Quote in a professional manner. Any additional work beyond the scope of the Quote requires written agreement between the parties. The bid does not include grading, soil preparations, amenities, maintenance, or watering unless otherwise stated. The bid is based on approximate quantities and site locations. The customer will be responsible for materials used in excess of estimated quantities and any additional costs resulting from site conditions beyond typical installation parameters, once the installation is complete.
  • Pricing: The prices in this proposal are valid for 30 days from the date of issuance. After 30 days, the amount of the proposal is subject to change due to factors beyond our control, such as increases in costs. Any changes in pricing will be disclosed to you before any work begins, and an updated quote will be required.
  • Payment: For residential projects, the customer shall pay the Contractor the full amount of the Proposal, including taxes and fees, as follows: 40% deposit upon acceptance of the proposal and the balance due upon completion.
  • Customer Representation and Obligations: The customer warrants that the site is free of underground conditions that may impede the landscape installation, unless specifically disclosed to the Contractor beforehand. If existing problems are encountered, additional charges may apply for necessary additional work, supplies, or alternative solutions. The customer agrees to provide electricity and water services to the Contractor while they are on-site.
  • 811Dig: The Contractor will request that local utilities are marked by the 811 Dig service. Customers agree not to move or disturb the flags and markings set up by the service until our work is completed, as it may disrupt service to the home and present a hazard to our technicians.
  • Completion: The Contractor will make commercially reasonable efforts to complete the project within the promised time frame. However, the Contractor shall not be liable for any delays in completion due to factors beyond their control.
  • Materials on Site: Once materials are delivered to the site, they become the responsibility of the customer. The Contractor accepts no responsibility for loss, damage, or expenses related to materials after delivery to the site. Any excess materials brought to or removed from the site beyond the Contractor's requirements under the Estimate remain the property of the Contractor, who has the right to enter the site to remove such materials.
  • Maintenance after Completion: The Contractor is only obligated to perform the work specified in the Estimate. Proper maintenance of the site, including irrigation and care of installed landscaping and sod, becomes the responsibility of the customer after completion of the work unless otherwise agreed upon in writing.

Residential Maintenance Terms and Conditions

The work performed by the Fast Lawnscapes for residential maintenance jobs will adhere to local codes and applicable government regulations. Our employees are trained to work safely and are knowledgeable about local environmental regulations.

Fast Lawnscapes carries insurance for public liability and property damage, with coverage amounting to 1 million dollars. Any incidents that result in actual, apparent, or potential damage or injury must be promptly reported to the Contractor. The Customer agrees to hold the Contractor harmless and indemnify them against any claims, actions, liabilities, obligations, costs, expenses, fees, etc., resulting from their failure to report such incidents.

The Customer also agrees to hold the Contractor harmless and indemnify them for any claims, actions, liabilities, obligations, costs, expenses, fees, etc., arising from incidents that result in actual, apparent, or potential damage or injury under the following circumstances:

  • Incidents occurring in areas of the property not serviced by the Contractor.
  • Incidents occurring during times when the Contractor is restricted from accessing the property to perform their duties.
  • Incidental damage to structures (e.g., home, other structures, fencing, screens) caused by handheld mechanical equipment when there are no buffer areas between the turf area being serviced and the structures. Repairing such incidental damage is not the responsibility of the Contractor.
  • Damages to sprinkler heads located in turf areas.
  • Damages resulting from wet weather conditions that cause damage to the turf due to tractor tires.
  • Exception: any damaged property, including light posts, patios, or buried cable lines that are caused by the Contractor, will be restored to its original condition at our expense. All aspects of these specifications may be amended upon mutual agreement.

Service rates may be subject to a fuel surcharge if the cost of regular unleaded fuel exceeds $3.50 per gallon.

We reserve the right to skip mowing services without notice or refund in cases where the technician deems it necessary due to climatic conditions, ongoing work on the property, excessive dog feces, or standing water. We will make every effort to reschedule when possible and promptly communicate the need to skip service to the customer.

It is mutually understood and agreed upon that either party may terminate this contract without cause by providing written notice of termination to the other party.

Payment Terms and Conditions

  • Residential Maintenance customers are required to store a credit card on file in order to begin services.  Your card will be automatically charged on the invoice due date of each month. Any additional services, such as first time cleanups or mulch installations, will be charged after the service is provided.
  • Late Payments - If the Customer fails to make payment when due, the past due balance shall be subject to a $25 or a 10% late fee, whichever is greater,  assessed each month that the invoice remains unpaid.
  • In the event that Contractor is required to collect any past due amounts from Customer or to enforce any terms, conditions, or covenants under this Agreement, Customer agrees to indemnify Contractor for all collection and enforcement costs incurred, including without limitation, reasonable attorney's fees and court costs.
